NEVADA RECLAMATION BOND POOL OBTAINS STATEWIDE BOND

The Nevada Division of Minerals is pleased to announce the Nevada Reclamation Performance Bond Pool has established a statewide reclamation performance bond with the Bureau of Land Management. The bond provides for the reclamation of notice-level operations conducted on public lands in Nevada under the federal regulations at Title 43 CFR 3809. The Bond Pool’s statewide bond was initiated upon the recommendation of a BLM/NDOM task force formed to streamline the notice-level bond adjudication business process.

The Bond Pool’s new statewide bond has been approved by the BLM. Therefore, participants in the new statewide bond will not be required to have their bonds individually adjudicated by the BLM. Using this option may provide a time savings for operators seeking to carry out notice-level operations on public lands.

In order to participate in the statewide bond the operator must provide the Bond Pool with copies of the original notice to the BLM and the letter from the BLM with the determination of the estimated reclamation cost. Participation in the Bond Pool requires a deposit equal to the bond amount in addition to an annual premium equivalent to 3% of the bond amount. No interest will be paid on the deposit while with the Bond Pool. Release of all or part of the deposit will be made upon receipt of a bond reduction or release letter from the BLM.

The operator will also be required to execute the Bond Pool’s standard bond form and indemnity agreement. Both of these documents can be obtained from the Division’s offices or found on the Division’s website. Upon completion of the documents and acceptance of payment the Division of Minerals will execute a BLM Surface Management Personal Bond Rider (Form 3809-4a) on behalf of the operator, and send the rider to the BLM State Office and a copy to the appropriate BLM Field Office. The operator is bonded upon submittal of the rider to the BLM.
